BOOKING (RESERVATION) TERMS
I. GENERAL PROVISIONS
1. These Order (reservation) Rules (hereinafter referred to as the “Rules”) regulate the procedure of selling accommodation and other services (hereinafter referred to as the “Services“) through the electronic reservation system of MB Agneta apartamentai (legal entity code: 307025240, registered office address: 3-1 Laisvės a., Druskininkai, tel.: +370 618 00899; e-mail:agneta@agneta.lt (hereinafter referred to as “MB Agneta apartamentai”), which is located on the website www.agneta.lt (hereinafter referred to as the “Electronic Reservation System“), as well as the mutual rights, duties and responsibilities of MB Agneta apartamentai and the Client.
2. MB Agneta apartamentai reserves the right to amend and supplement these Terms and Conditions at any time. When using the electronic booking system, the Terms and Conditions in force at the time of booking will apply.
3. Before entering the requested data and making the payment of the order at , the Customer confirms that he/she has read the MB Agneta apartamentai booking/reservation policy by ticking the box in the booking window next to the “I have read and agree to the Privacy Policy and the booking/reservation policy”. The Customer shall not be given the opportunity to make a reservation unless he/she has read and acknowledged these Terms and Conditions and the Privacy Policy. MB Agneta apartamentai assumes no risk and is unconditionally exempt from liability if the Client has not fully acquainted themselves with these Terms and Conditions.
4. The following are entitled to make bookings in the electronic booking system:
4.1. able-bodied natural persons, i.e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court order (minors may use the services of MB Agneta apartamentai only in the company of an adult who is responsible for the supervision and safety of minors. An adult is a person over 18 years of age who takes full responsibility for the care and behaviour of the children who arrive with him/her, for the observance of these rules, and for the proper care of the children’s belongings)
4.2. legal persons acting through authorised representatives;
4.3 Authorised representatives of all persons referred to in sub-paragraphs 4.1 to 4.3 of these Rules.
5. The information in the electronic booking system is available in Lithuanian, English and Polish.
II. PROCEDURES AND DEADLINES FOR SELECTING AND PAYING FOR RESERVATIONS
6. The client can choose standard accommodation in the apartments offered by MB Agneta apartamentai.
7. After familiarising yourself with the apartments and the standard room rates, you must select your preferred apartment, enter your preferred arrival and departure times, specify the number of arriving adults and children. At the same time, the client has the option to order breakfast in the room for an additional fee (by ticking the box next to the additional service).
8. Once the client has entered all the above data, the electronic reservation system will provide the final price for all services booked.
9. After clicking on the booking button, the Customer is presented with an order basket and detailed order information. After clicking on the “pay” button, the Customer is taken to the next step, where he/she indicates his/her name, contact telephone number, email, address and his/her comments regarding the reservation.
10. After filling in the above data, the Customer may make payment by electronic bank transfer. After selecting one of the specified credit institutions, the Customer is redirected to a page where he/she can make the payment using the electronic payment system Paysera LT, UAB. Data authorization starts with the connection to the Paysera LT, UAB system using an encrypted 128-bit protocol. Once the payment has been accepted by the Paysera LT, UAB system, the Customer is automatically notified of the payment and the reservation by e-mail. The email will contain: the customer’s details, the name of the apartment, the total price of the accommodation (and, if booked, other services), and the amount paid. Please note that upon arrival, the client may be asked to present this email as proof of payment.
11. Prior to making a payment, the Customer is informed that the account information and payment initiation services will be provided by Paysera LT, UAB in accordance with the Paysera LT, UAB Service Provision Rules. By proceeding with the payment, the Customer shall be deemed to confirm that he/she accepts the provision of services by Paysera LT, UAB, and agrees to and is familiar with both the rules and procedures of the services provided by Paysera LT, UAB, as well as the privacy policy and personal data processing rules of Paysera LT, UAB.
12. The Client understands that in the event of a malfunction/programming error in the electronic reservation system, if the published price of the reservation is unreasonably low/high, taking into account the composition of the reservation, MB Agneta apartamentai shall have the right to inform the Client of the error within 10 days from the confirmation of the reservation and to demand payment of the full price, and in the event of the Client’s refusal to pay the full price, to terminate the contract/decline the services, without any compensation for the Client.
14. Prices for services in the electronic booking system are quoted in euros. They do not include a tourist tax of EUR 2 (two) per day, set by the Druskininkai Municipal Council, which must be paid additionally upon arrival at the apartment.
14. When MB Agneta apartamentai receives confirmation of payment, the Client and MB Agneta apartamentai shall be deemed to have entered into a service contract. MB Agneta apartamentai shall not be liable for the failure to conclude a service contract due to the failure to receive timely confirmation of payment in accordance with the terms and conditions set out in these Rules.
III. PROVISION OF SERVICES, CANCELLATION OF RESERVATIONS
15. Services provided exclusively by MB Agneta apartamentai.
16. The client has the right to cancel his/her reservation no later than 3 (three) days before the start of the services by writing toagneta@agneta.lt .In this case, MB Agneta apartamentai is obliged to refund the total amount paid by the client within 10 working days after the submission of all the information necessary for payment to MB Agneta apartamentai.
17. In the event that the Client wishes to cancel his/her reservation less than 3 (three) days prior to the commencement of the services or fails to arrive at the apartment without providing any information, the Client shall be refunded the amount paid by him/her, less any losses incurred by MB Agneta apartamentai as a result of the delayed cancellation or failure to appear. The minimum loss incurred by MB Agneta apartamentai will be the price of the first night, if booked.
IV. DISPUTE RESOLUTION
18. All disagreements arising between the Client and MB Agneta apartamentai regarding the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.
19. To make a claim or resolve a problem, the Client must contact MB Agneta apartamentai in writing. The following methods of submitting a claim and written appeal are available:
19.1. by sending an email to:agneta@agneta.lt ;
19.2. by sending it to Laisvės a. 3-1, Druskininkai.
20. The client may apply to the State Consumer Rights Protection Service for out-of-court settlement of consumer disputes (A. Goštauto g. 12, 01108 Vilnius, e-mail: tarnyba@vvtat.lt, telephone (8 5) 262 6751, website: www.vvtat.lt ) or fill in the application form on the Electronic Dispute Resolution (EDR) platform
V. FINAL PROVISIONS
21. Customers can purchase services by logging in to the online booking system and providing the following information:
21.1. the name and surname of the natural person, contact telephone number, email address, address;
21.2 The Customer’s data shall be entered only for the purpose of confirming the order (reservation) and its execution. No customer account shall be created in the electronic reservation system and no data on previous reservations shall be stored.
22. When ordering services, the Client must correctly specify the data requested. MB Agneta apartamentai shall not be liable for incorrectly selected arrival or departure dates and/or other incorrect data provided by the Client.
23. The electronic payment system Paysera LT, UAB is responsible for the correct handling of payments for orders (reservations).
24. MB Agneta apartamentai is not responsible for the unavailability of the electronic reservation system through no fault of its own, or for any other problems beyond its control.
25. Personal data provided by the Client shall be processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing of personal data. When processing and storing the Client’s personal data, MB Agneta apartamentai shall follow the privacy policy, ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing. The client’s personal data is processed for direct marketing purposes only with the client’s consent. The customer’s consent shall be indicated in the relevant field in the electronic reservation system. The person making the reservation on behalf of another person(s) undertakes to ensure that the data of such person(s) is provided to MB Agneta apartamentai with their knowledge and consent, and shall be liable for any damage caused to third parties if their data has been provided to MB Agneta apartamentai without their consent.
26. The Client shall always have the right, upon request to MB Agneta apartamentai, to have access to his/her personal data processed by MB Agneta apartamentai, to find out how it is processed, to request the correction, destruction of his/her data or to suspend, except for storage, the processing of his/her data, where the data is processed in violation of the provisions of the Law on the Legal Protection of Personal Data and of the provisions of other legal acts regulating personal data processing.
27. Customers’ personal data will be used and stored in accordance with the procedures and terms set out in the Privacy Policy.
28. MB Agneta apartamentai sends all notifications to the Client using the contact details provided at the time of booking. MB Agneta apartamentai shall not be liable if the Client does not receive notifications sent by MB Agneta apartamentai due to disruptions in the network of the electricity, internet connection, e-mail service providers or incorrect data provided by MB Agneta apartamentai.
29. The Client shall send all notifications and questions to MB Agneta apartamentai to the email address specified in the “Contacts” section of the website www.agneta.lt.
30. If any provision of these Rules is declared invalid by a decision of the competent authority, this shall not affect the validity of the other provisions, which shall remain in force. Any provision of these Rules which is invalidated only in part shall remain in force to the extent that it has not been invalidated.
31. The Rules may be consulted and printed at any time at www.agneta.lt. Customers will always be informed of any future changes and/or additions to the Terms and Conditions by posting the new version of the Terms and Conditions on the website www.agneta.lt.
